Sir Maurice Gwyer says that he has written

twice to the Treasury, offering to take the costs

on his vote, and quoting precedents, but has had

no reply. He suggests that you might reply semi-

officially to this letter, saying that you under-

stand the Treasury Solicitor is willing to take the

costs, but is waiting to hear from the Treasury,

and point out that there is not now any question

of an appeal, but of a special reference by the

Secretary of State.
